County To Appeal
Courts Ruling On EIR

Mittermeier announced today that the County of Orange
is readying an appeal of the decision issued this afternoon
by Judge Judith McConnell of the San Diego Superior Court.
Todays decision in the litigation brought against
the MCAS El Toro Community Reuse Plan Environmental Impact
Report was basically unchanged from the tentative ruling
issued October 10. That ruling found for the petitioners
on a number of issues and for the County on a number of
others.
"I am surprised by the judges ruling and do
not believe that her decision accurately reflects the
facts of the case," said Mittermeier. "This
EIR is thorough and accurate and complete. Based on the
advice of counsel and upon receipt of the final documents
from the court, I have recommended that we appeal the
judges decision. I am confident that our analysis
and the EIR will be upheld on appeal."
Mittermeier went on to say that the reuse planning process
will not be halted by the appeal process.
"We will continue full speed ahead toward the completion
of our specific plan, airport system master plan and second
environmental impact report."
